Right to Employment

 

  1. In 2003, HB630 was enacted into law. It created the Employed Individuals with Disabilities Program. The purpose of this program is to encourage individuals with disabilities to get a job or to maintain employment while keeping their Medicaid benefits.   2. In 2024, HB822/SB790 was enacted into law. This law made several important changes to the Employed Individuals with Disabilities Program. It revised the program by making it clear that transition students (age 14 and up) could work and still maintain their Medicaid benefits. It also prohibits the health department from limiting eligibility on the basis of the spouse’s income, assets, and resources, thus removing the marriage penalty. It permits seniors aged 65 and above to work while maintaining their Medicaid benefits.
